Terms of Service

These Terms of Service ("Terms") govern your use of CaptainOS. By creating an account, subscribing, or using the service, you agree to these Terms. If you do not agree, please do not use CaptainOS.

The service

CaptainOS provides software for charter fishing guides, including the Dock Desk AI booking agent ("Marina"), Bite Logger, and related features. We may add, change, or remove features over time.

Your account

You are responsible for the accuracy of the information you provide and for keeping your account credentials secure. You must be at least 18 years old and use CaptainOS for legitimate business purposes.

Subscriptions & billing

• CaptainOS is offered on a recurring monthly subscription, billed in advance through Stripe.
• The Founder's Rate, where offered, remains locked at the stated price for as long as your subscription stays active and uninterrupted.
• You can cancel at any time; cancellation takes effect at the end of your current billing period.
• Except where required by law, payments are non-refundable for partial periods.
• We may change standard pricing with reasonable notice; changes will not affect a locked Founder's Rate while it remains active.

Acceptable use

You agree not to misuse CaptainOS, including by using it for unlawful purposes, attempting to disrupt or reverse-engineer the service, or using it to send unsolicited or deceptive communications. You are responsible for complying with applicable laws governing call recording, SMS messaging, and customer data in your jurisdiction.

AI & bookings

Marina is an automated assistant. While we work to make it accurate, you are responsible for reviewing and confirming bookings, pricing, and availability. CaptainOS is not liable for errors in automated call handling or for bookings you choose to honor or decline.

Third-party services

CaptainOS integrates with third parties such as Google Calendar, Stripe, and telephony/SMS providers. Your use of those services is subject to their own terms and policies.

Your content

You retain ownership of the data you put into CaptainOS, including your bite logs and client information. You grant us a limited license to process that data solely to operate and improve the service, as described in our Privacy Policy.

Disclaimers & limitation of liability

CaptainOS is provided "as is" without warranties of any kind. To the maximum extent permitted by law, CaptainOS is not liable for indirect, incidental, or consequential damages, or for lost bookings, revenue, or data. Our total liability for any claim is limited to the amount you paid us in the three months preceding the claim.

Termination

You may stop using CaptainOS at any time. We may suspend or terminate access if you violate these Terms or use the service in a way that risks harm to others or to the service.

Changes

We may update these Terms from time to time. Continued use after changes take effect constitutes acceptance of the updated Terms.
